Please read these Terms and Conditions carefully before using the Moves Method app.
1. Acceptance of Terms
By downloading, installing, or using the Moves Method app ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and BONDI MOVES PTY LTD ("Moves Method", "we", "us", or "our").
2. Eligibility
You must be at least 18 years of age to use the App. By using the App, you confirm that you are 18 or older. If you are under 18, you are not permitted to use the App.
3. Health and Medical Disclaimer
Moves Method is a movement education programme. The App and its content, including assessments, workouts, and any feedback provided, are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment.
If you have any concerns about your physical health, are recovering from an injury, or have a pre-existing medical condition, consult a qualified healthcare professional before using the App or beginning any exercise programme. Do not disregard professional medical advice or delay seeking it because of something you have read or experienced in the App.
You are solely responsible for determining whether you are physically ready to exercise and for ensuring that any exercise you perform is appropriate for your current fitness level and health status. By using the App you confirm that you have assessed your own physical readiness and voluntarily assume the inherent risks associated with physical exercise.
Any recommendations, assessments, or feedback provided by the App, including AI-generated content, are for informational and educational purposes only. They do not account for your full medical history and should not be relied upon as a substitute for professional medical or fitness advice.
Use the App at your own risk. Moves Method is not liable for any injury, loss, or damage arising from your use of the App or participation in any programme.
4. Account and Local Data
When you first open the App, a local profile is created on your device. This allows you to use core features before registering. Local data is stored only on your device and is not synced to our servers until you create a registered account.
To access the full features of the App, you must register an account by providing a valid email address and creating a password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may only create one account per person. You agree to provide accurate and complete information during registration and to keep it up to date.
5. Subscriptions and Billing
Subscription: Access to the full Moves Method programme requires a paid subscription. Subscription plans and pricing are displayed in the App and on the App Store listing.
Billing: Subscriptions are billed through Apple in accordance with your App Store account settings. Payment is charged to your Apple ID at confirmation of purchase.
Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the App until then.
Refunds: Subscription fees are non-refundable except as required by applicable law. Refund requests are handled by Apple in accordance with their App Store refund policy. By starting your subscription immediately upon purchase, you expressly request early access to the service and acknowledge that your right of withdrawal expires upon commencement of the subscription.
Free Trial: Both the monthly and annual subscription plans include a 7-day free trial. The trial begins at the time of purchase. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your Apple ID will be charged for the first billing period. You can cancel at any time through your Apple ID account settings. Unused free trial periods are forfeited upon purchasing a subscription.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorised access to any part of the App or its infrastructure
- Reverse engineer, decompile, or disassemble the App
- Upload or transmit any content that is harmful, offensive, or violates any applicable law
- Use the App in any way that could damage, disable, or impair the service
7. Intellectual Property
All content within the App, including but not limited to text, graphics, logos, images, workout programmes, and assessments, is the property of Moves Method or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from any content in the App without our prior written consent.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App you agree to the collection and use of your data as described in the Privacy Policy.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Moves Method and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use the App.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account and access to the App at our sole discretion, with immediate effect in cases of serious or repeated breach, or with reasonable notice in all other cases, if we believe you have violated these Terms or applicable law.
You may delete your account at any time through the App settings. Upon deletion, your data will be handled in accordance with our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. For material changes — those that affect your rights, subscription terms, or how your data is used — we will notify you in advance through the App and require your explicit acceptance before you can continue using the service. For non-material corrections or clarifications, we will notify you through the App or by email, and continued use after the changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Australia.
If you are resident in the European Economic Area or United Kingdom, mandatory consumer protection laws and data protection laws of your country of residence apply in addition to these Terms and prevail to the extent of any inconsistency. Nothing in this clause affects your rights as a consumer under the mandatory laws of your country of residence.
